ITAR REQUIREMENTS

Nobles’ products are subject to the U.S. Government ITAR regulations. Below is a brief outline highlighting the process for each major license that is typically used by Nobles.

Technical Assistance Agreement (TAA)
  • A TAA allows all parties to share technical data specified by the agreement. The TAA will be valid for 10 years.

  • It is the responsibility of both parties to determine the programs and products to be addressed in the TAA.

  • Each party to the agreement shall provide a list of countries for all dual/third country nationals that are employed or contracted with employer that will potentially work on the projects.

  • Each party in the agreement shall provide a brief company overview and a description of its involvement in the defense industry.

  • Nobles will draft the initial TAA. The draft TAA will be agreed upon by each party, prior to the submission.

  • Nobles will submit the agreed upon TAA to the U.S. Department of State.

  • Upon approval by the U.S. Department of State, final documents will be created and distributed for signature.

DSP-73 Export License
  • A DSP-73 allows for the temporary export of products regulated by the U.S. Department of State, and will be valid for 4 years.

  • The customer(s) shall supply a letter on entity letterhead expressing interest in the product(s).

  • The customer(s) shall supply the physical addresses of where the product(s) will be while in country.

  • Once all of the information is received, Nobles will submit the application.
DSP-5 Export License
  • A DSP-5 is the regulatory process that allows for the permanent export of a specific product.

  • The customer shall provide a purchase order for the product.

  • The customer shall provide an end user statement for the transaction.  The end user statement shall include the following information:

    • Country of ultimate destination

    • Specific purpose for which the material is required (caliber of gun, name of the gun system, name of the program the gun system will be used on, etc.)

    • Name and address of the foreign ultimate end user (need complete street address, PO Box is not acceptable).

    • Name and address of the foreign end user (need complete street address, PO Box is not acceptable).

    • Name and address of intermediate foreign end user(s) (the list of intermediate foreign end users shall include any freight forwarders or shipping companies that will be part of the shipping process) (need complete street address, PO Box is not acceptable).

  • If an import license is required, the customer shall supply a copy of the license.

  • Once all of the information is received, Nobles will submit the application.
